Welcome to Streaml. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Streaml, Inc. ("Streaml," "we," "us," or "our") governing your access to and use of our AI-powered sales automation platform, including all related websites, applications, and services (collectively, the "Service").

Important: By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Eligibility

Service Availability

3. Account Registration and Security

  • One person or entity may not maintain multiple free accounts

Account Security

Account Sharing

Account credentials may not be shared with third parties. Each user must have their own account with appropriate subscription level.

4. Acceptable Use Policy

You agree to use the Service in compliance with all applicable laws and regulations. You shall not:

Prohibited Activities

  • Use the Service for any unlawful purpose or to violate any laws
  • Send unsolicited commercial communications (spam) in violation of applicable laws
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers or networks connected to the Service

5. Subscription and Payment

Billing

Free Trials

  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial billing periods

6. Intellectual Property Rights

Streaml Ownership

The Service and all related technology, including software, algorithms, designs, graphics, and documentation, are owned by Streaml and protected by intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property except the limited license to use the Service.

License to Use Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription period.

Restrictions

  • You may not copy, modify, or create derivative works of the Service
  • You may not sublicense, sell, or transfer your access to the Service
  • You may not use our trademarks without prior written consent

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide license to use such feedback without compensation or attribution.

7. User Content and Data

Your Content

You retain ownership of all data, content, and materials you upload or input into the Service ("User Content"). You grant Streaml a limited license to use, process, and store User Content solely to provide and improve the Service.

Data Processing

Data Portability

You may export your data from the Service at any time. Upon termination, you will have a limited period to export your data before it is deleted.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amounts paid by you in the twelve months preceding the claim
  • We are not responsible for any loss of data, profits, or business opportunities

AI-Generated Content

The Service uses artificial intelligence to generate content and recommendations. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You are responsible for reviewing and verifying all AI-generated content before use.

Third-Party Services

We are not responsible for any third-party services integrated with or linked from the Service. Your use of third-party services is at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless Streaml, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your User Content or any content you transmit through the Service
  • Your infringement of any third-party rights

10. Termination

Termination by You

You may terminate your account at any time by canceling your subscription and closing your account through the account settings.

Termination by Streaml

We may suspend or terminate your access to the Service at any time, with or without cause, including if:

  • You violate these Terms
  • You fail to pay applicable fees
  • Your use of the Service poses a security risk
  • We are required to do so by law

Effect of Termination

  • Upon termination, your right to use the Service immediately ceases
  • You will have 30 days to export your data after termination
  • We may delete your data after the export period expires
  • Provisions that should survive termination will remain in effect

11. Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

  • Informal Resolution: First, by contacting us to attempt to resolve the dispute informally
  • Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
  • Class Action Waiver: You waive any right to participate in class action lawsuits or class-wide arbitration

Jurisdiction

For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes:

  • We will notify you via email or through a prominent notice on the Service
  • Changes will take effect 30 days after notice unless otherwise specified

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
